“一带一路”倡议为中国的企业家带来了开拓新兴市场的商业机遇，也对律师的跨境法律服务提出了更高的要求，为了更好地面向我国企业走出去提供投资策略与法律服务，2019年6月22日下午，广东广信君达律师事务所特邀来自马来西亚、印度、越南、缅甸、菲律宾、印度尼西亚的东南亚律师齐聚广信君达，在本所开展中国企业走出去“一带一路”沿线国家投资策略座谈会，分享上述国家最新跨境投资攻略，为中国企业走出去保驾护航。近百名企业负责人、律师同行、相关媒体等参加座谈会，氛围热烈。

  On June 22nd , ETR Law firm invited lawyers from Indonesian,Malaysia, India, Vietnam, Myanmar and Philippines to hold a forum on ‘ Investment Strategies for Chinese Go Out Enterprises Along The Belt And Road ’ for Chinese enterprises. Guests from these nations shared the latest cross-border investment strategies in their countries and gave advice to entrepreneurs as well as lawyers in areas of foreigninvestment. Representatives from almost 100 enterprises, lawyers and relevant medias attend the forum.

  首先，闪涛律师代表本所对各位莅临的嘉宾及与会者致以热烈的欢迎。他表示，随着我国企业越来越积极走出去，与东南亚国家的经贸往来也愈加频繁，故特邀东南亚六国的律师为各企业家分享最新的跨境投资攻略，为在场律师带来新思路，希望大家可以碰撞出思想火花，寻求合作机遇。

  First , the representative of the our firm, Davy Shan delivered a warm welcome speech to all the guests and participants. He pointed out that as the economic and trade exchanges with Southeast Asian countries have become more and more frequent, it is necessary to bring new ideas on national investment strategies and he was sure that the forum would help both entrepreneurs and lawyers to seek cooperation opportunities under the ‘ Belt and Road Initiative ’ .

  Jeff Leong律师以“中国在马来西亚投资”为主题，立足于马来西亚的地理优势、投资机会、激励政策及中马友好合作等现状进行了解说和分析。他指出，当今新的经济形势下，马来西亚新政府十分支持“一带一路”倡议，希望马来西亚能与中国长期建立友好关系。Jeff Leong律师表示，若中国企业能抓住这一发展机遇，将极大增强企业的经济发展后劲。

  Based on Malaysia's geographical advantages, investment opportunities, incentive policies and close cooperation between China and Malaysia, lawyer Mr. Jeff Leong delivered a speech on ‘ Malaysia as a principal hub for Chinese investments along the maritime silk road ’. He analyzed the current situation of Chinese investment in Malaysia and pointed out that the new government is now fully supports the ‘ Belt and Road Initiative ’ under the new economic development and he concluded that Malaysia would like to establish close relations with China in the long run.

  Carlos Ocampo律师就“中国企业如何在菲律宾投资”进行了分析和讲解，介绍了菲律宾经济概观、商业及投资者的法律环境及相关改革等，他指出，菲律宾现在进入了“人口红利最佳点”，更多的投资可推动超过7％的增长。同时，菲律宾正为各行业的大量外国投资的涌入作准备，进行相关改革，确保能与投资企业实现共赢。Carlos Ocampo律师表示，目前菲律宾的投资环境和当前政府对此的支持和改革对外国投资者来说是理想的选择。

  Lawyer Mr.Carlos Ocampo analyzed and explained ‘ How Chinese companies invest in  Philippines’. He introduced the economy situation , legal environment for  investors and related reforms happened in Philippines . He pointed out that  Philippines has entered the ‘demographic sweet spot’ and it is now preparing for foreign investment in various industries areas to make sure that it can achieve win-win results with investors . He concluded that the current investment environment in Philippines and the current government's supports are in the best period.

  Alphonse Nguyen律师围绕“如何在越南投资制造型企业”作了精彩分享，介绍了越南基本情况、中国对越南直接投资的贸易协议以及越南在贸易协议、劳动力成本、优惠税收政策方面的优势，并为大家讲解了在越南设立制造公司的相关步骤。他指出，在申请地方当局批准赴越南投资许可之前，中国投资者必须与工业园签署土地租赁协议谅解备忘录。

  Lawyer Mr. Alphonse Nguyen made a share on ‘ How to invest in manufacturing enterprises in Vietnam ’. He introduced the basic situation in Vietnam, the trade agreement on direct investment by China and the advantages of Vietnam in terms of trade agreement, labor cost and preferential tax policy. He also explained the relevant steps in the establishment of manufacturing company in Vietnam. He pointed out that before investment in Vietnam, the importance of signing the memorandum of understanding should not be ignored by Chinese investors.

  Paurush Kumar律师以“在印度最小化风险和最大化机会”为主题，从印度热门投资领域、投资模式、投资路径、审批程序、挑战与阻碍及特有的法律风险等方面进行了分享。Paurush Kumar律师给即将在印度开展业务的中国公司的一些提示：第一、做适当的尽职调查；第二、获取有关您希望开展业务的行业的法律、法规、政策和业务报告；第三、自己对税务、监管合规、劳工和工厂法律方面的问题进行监督；第四、获得所有有关合同和协议的法律建议；第五、聘请法律顾问可以最大限度地降低风险，并将有效提高企业在印度发展的机会。

  Lawyer Mr. Paurush kumar shared topic on ‘ Minimizing risks & Maximizing Opportunities in India ’. He shared a number of tips from china's investment areas, investment models, investment paths, approval procedures, challenges, obstacles and specific legal risks. He also gave five main tips to Chinese companies with the wish to do business in India, including : the key role of appropriate due diligence; the importance of familiar with laws, regulations of targeted industries, the importance of the tax issue , labor etc. He also highlighted the importance of getting legal advice from professional legal counsels.

  Richard Haw律师立足“中国企业如何在缅甸投资”主题展开分享，他首先向大家介绍了缅甸的经济及投资状况，同时指出中国目前已成为在缅甸投资的第一大国。并表示缅甸外商投资重点行业的前三分别是石油与天然气、能源、制造业，基于此，Richard Haw律师解读了缅甸投资法、贸易法相关规定以及缅甸经济特区的优惠政策等。还为大家总体解读与分析了缅甸的投资机会和相关风险。

  Lawyer Mr.Richard Haw shared topic on ‘ How Chinese companies invest in Myanmar ’.He first introduced the economic and investment situation in Myanmar then he shared the three key industries of foreign investment in Myanmar. Based on introducing the Myanmar investment law and the relevant provisions of the trade and  preferential policies of its special economic zone, He conclude the huge investment opportunities as well as certain risks for Chinese investors to invest in Myanmar.

  Michael S. Carl律师以“印度尼西亚欢迎BRI”为主题展开精彩分享，他表示“一带一路”倡议对印度尼西亚来说是极大的发展机遇，一旦落地生根后，印度尼西亚的发展前景将变得更加广阔。基于印度尼西亚的人口规模，他介绍了印度尼西亚电子商务、数字化经济、超级程序的发展优势及其良好的发展现状，欢迎中国企业进行投资。他表示，印度尼西亚政府为中国投资者制定了公平、透明的投资政策和优惠。

  Lawyer Mr.Michael S. Carl shared the theme on ‘ Chinese Investment in the Digital Silk Road: The Indonesian Model ’.He said that the ‘ Belt and Road Initiative ’ is a great opportunity for Indonesia and Indonesia's development prospects would become broader when such opportunities are seized . Based on the population size of Indonesia, he introduced the advantages of Indonesian e-commerce, digital economy, and super program. He finally concluded that Chinese enterprises are welcomed to invest in Indonesian and its government has formulated a fair and transparent investment policies as well as certain preferences for Chinese investors.

  最后，闪涛律师结合以上分享律师的演讲，他表示，企业走出去时不仅要认识到语言翻译的必要性，也要深刻体会到聘请专业律师团队的重要性。企业走出去过程中需借力律师团队进行充分的尽职调查，合法合规地设立公司，并聘请相应的境内外律师担当起法律总协调和总牵头的作用，从而防止出现信息失真的情况。

  Finally, Davy Shan concluded the importance of hiring professional lawyers when setting investment strategies. And it is necessary to hire lawyers in different sections such as : procedures of due diligence, familiarity with corresponding domestic rules,etc. In the free communication section, all participants exchanged ideas  actively .
